Terms and Conditions

Please read these terms carefully before making a booking or payment. By proceeding you confirm you have read, understood and accepted them.

These Terms and Conditions, together with the applicable quotation, itinerary, invoice, booking confirmation, supplier terms and our Privacy Policy, form the agreement between you and Bella Safaris Limited. If there is a conflict, the specific terms in your confirmed quotation or booking confirmation will apply to that booking, followed by these Terms and Conditions, then the relevant supplier's terms.

By making a booking or payment, you confirm that you have read, understood and accepted these Terms on your own behalf and on behalf of every traveller in the booking, and that you are authorised to do so.

About Bella Safaris

Bella Safaris Limited (“Bella Safaris”, “we”, “us” or “our”) is a tours and travel company incorporated in Kenya. Our services may include safaris, accommodation, flights, transfers, vehicle hire, excursions, corporate travel and tailor-made travel arrangements.

Definitions

In these Terms:

  • Bookingany travel service requested by you and confirmed by us in writing.
  • Lead travellerthe person who makes the booking and communicates with us on behalf of all travellers.
  • Packagea combination of two or more travel services sold together.
  • Supplieran independent third party providing any part of your booking, including an airline, hotel, lodge, camp, transport operator, park authority, guide or activity provider.
  • Travellerevery person named or included in a booking.
  • Websiteany website, online booking page or digital platform operated by or on behalf of Bella Safaris.

Quotations, Prices and Availability

3.1All quotations are subject to availability and are not confirmed until we receive the required payment and issue a written booking confirmation.

3.2Unless otherwise stated, a quotation is valid only until the expiry date shown on it. Airfares, accommodation, park fees, taxes and supplier charges may change without notice before confirmation.

3.3Prices are based on the number of travellers, rooming arrangements, travel dates, itinerary, exchange rates, taxes, levies, park fees and supplier rates known when the quotation is prepared. If any of these details change before confirmation, we may revise the price.

3.4Your quotation or invoice will state what is included and excluded. Unless expressly included, prices do not normally cover passports, visas, vaccinations, travel insurance, personal expenses, tips, optional activities, excess baggage, hotel incidentals, local tourism or resort taxes, bank charges, card-processing charges or services not listed in the itinerary.

3.5Prices advertised online are indicative and may be subject to conditions, availability, minimum occupancy, travel periods and supplier restrictions. An obvious pricing, typing or system error does not bind us.

3.6Unless otherwise stated, payments must be made in the invoiced currency. Where we accept payment in another currency, the conversion rate and any applicable bank or transfer costs will be confirmed at the time of payment.

Booking and Contract Formation

A booking request or quotation is not a confirmed reservation. A binding contract is formed only when:

  • we have received the required deposit or full payment in cleared funds;
  • the relevant services have been confirmed by the suppliers; and
  • we have sent you a written booking confirmation.

4.2The lead traveller must check all names, dates, destinations, flight details, room types and other booking information immediately after receiving the confirmation. Names must match the travellers' passports or identification documents exactly. Any error must be reported promptly; amendment charges may apply.

4.3We may decline a booking before confirmation where services are unavailable, payment cannot be verified, legal or regulatory requirements are not met, or we reasonably suspect fraud or misuse.

Payments

5.1The required deposit, instalment dates and final-payment deadline will be stated in the quotation or invoice. Different suppliers may impose different payment conditions.

5.2A deposit may be non-refundable to the extent that it has been paid or committed to suppliers on a non-refundable basis, provided this was disclosed in the quotation, invoice, confirmation or applicable supplier terms.

5.3If payment is not received by the stated deadline, we may treat the booking as cancelled by you after giving reasonable notice. Cancellation charges may apply, including supplier charges already incurred.

5.4You are responsible for all bank, transfer, foreign-exchange and card charges unless we expressly agree otherwise.

5.5Bella Safaris will issue a receipt or other payment acknowledgement. You must not make payment to an employee's or third party's personal account unless Bella Safaris has confirmed that payment method through an authorised company communication channel.

Supplier Terms and Bella Safaris' Role

6.1We arrange travel services directly or through independent suppliers. Supplier services are also governed by the supplier's conditions, including rules on check-in, baggage, changes, cancellations, refunds, safety and conduct. We will make material supplier conditions available on request or where they are relevant to your booking.

6.2Where Bella Safaris acts only as an agent for a disclosed supplier, the contract for that service is between you and the supplier, and our responsibility is to exercise reasonable care and skill in arranging the service. Where we organise and sell services as a Bella Safaris package, we remain responsible for performing our obligations under the package agreement, subject to these Terms and applicable law.

6.3Nothing in these Terms excludes any responsibility that the law does not permit us to exclude.

7

Amendments Requested by You

7.1Amendment requests must be made in writing by the lead traveller. A request is not effective until we confirm it in writing.

7.2Changes are subject to availability and supplier approval. You must pay any difference in price, supplier penalty, non-recoverable cost and reasonable administrative fee disclosed before the change is processed.

7.3A name change may be treated by an airline or other supplier as a cancellation and new booking. Tickets and certain promotional rates may be non-changeable and non-transferable.

7.4If a requested change significantly alters the original booking, it may be treated as a cancellation and rebooking.

Cancellation by You

8.1Cancellation must be submitted in writing by the lead traveller. It takes effect when received by Bella Safaris during normal business hours.

Cancellation charges will be those stated in your quotation, invoice or booking confirmation. If no Bella Safaris cancellation schedule is stated, the amount retained will be limited to:

  • non-refundable or non-recoverable supplier charges;
  • payment, bank or foreign-exchange costs that cannot reasonably be recovered; and
  • a reasonable amount for work already performed, where permitted by law.

8.3We will provide a breakdown of applicable cancellation deductions on request.

8.4Air tickets, promotional fares, permits, park fees, gorilla or other special permits, and certain hotel or festive-season bookings may be wholly non-refundable once issued or confirmed.

8.5No refund is normally available for a no-show or for services voluntarily missed, declined or unused after travel begins, unless the failure results from our breach or applicable law requires otherwise.

8.6We strongly recommend comprehensive travel insurance that includes cancellation and interruption cover.

Cancellation or Significant Changes by Bella Safaris

9.1Travel arrangements may occasionally require changes because of operational, safety, weather, road, park, airline, accommodation or supplier circumstances.

9.2We may make minor changes that do not materially reduce the overall value or quality of the booking. We will notify you of a significant change as soon as reasonably possible.

If, before departure, we cancel your confirmed booking for reasons other than your breach or circumstances beyond our reasonable control, or make a significant change that you do not accept, you may choose, subject to availability:

  • an equivalent or reasonably comparable alternative;
  • a lower-priced alternative plus a refund of the difference; or
  • cancellation and a refund of the amount paid for the affected services, less any sums that suppliers are legally entitled to retain and that were clearly disclosed as non-refundable.

9.4If a confirmed hotel becomes unavailable, we will use reasonable efforts to provide accommodation of a similar or higher standard. If the substitute is materially inferior, an appropriate price adjustment will be considered.

9.5During a safari, routes, game drives and activities may be changed where reasonably necessary for safety, weather, wildlife movements, road conditions, park rules or operational reasons. Wildlife sightings are natural events and cannot be guaranteed.

Force Majeure and Events Beyond Our Control

10.1Neither Bella Safaris nor a supplier will be liable for failure or delay caused by an event beyond the affected party's reasonable control, including severe weather, flood, fire, earthquake, epidemic or pandemic, government action, border closure, war, terrorism, civil disturbance, strike, airport or airspace closure, transport disruption, utility failure or a similar event (a "Force Majeure Event").

10.2Where a Force Majeure Event affects a booking, we will use reasonable efforts to assist, rearrange or recover funds from suppliers. Refunds or credits will depend on the amounts actually recoverable, the supplier terms and applicable law. Reasonable additional costs of alternative arrangements, accommodation, meals, repatriation or extended stays are the traveller's responsibility unless covered by the supplier, Bella Safaris, applicable law or travel insurance.

10.3Nothing in this clause limits any refund or other right that cannot lawfully be excluded.

Flights

11.1Airline bookings are governed by the airline's conditions of carriage and fare rules. Flight times, routes, aircraft and schedules may change.

11.2Travellers must reconfirm flight details, arrive within the airline's check-in time and carry valid travel documents. Failure to use one flight sector may cause an airline to cancel later sectors on the same ticket.

11.3Additional charges may apply for baggage, seats, sports equipment, meals, wheelchair assistance and other services. These charges are determined by the airline and may change.

11.4Where a flight is delayed, cancelled or rescheduled, the airline is primarily responsible for remedies under its conditions and applicable aviation law. Bella Safaris will provide reasonable assistance but cannot guarantee the airline's response or processing time.

Accommodation

12.1Check-in and check-out times, deposits, child policies, meal plans, room occupancy and incidental charges vary by property. Travellers must comply with the property's rules.

12.2Hotel and lodge classifications vary between destinations. Descriptions, photographs and ratings are supplied in good faith and may change. Room images may represent a category rather than the exact room allocated.

12.3Bedding, adjoining rooms, views, accessibility arrangements, dietary needs, early check-in and late check-out are requests unless expressly confirmed in writing. Additional charges may apply.

12.4Local taxes, tourism levies, resort fees, conservation charges, deposits, minibar, laundry, telephone use, damage and other incidentals are payable directly by the traveller unless expressly included.

12.5The traveller is responsible for loss or damage caused to accommodation, vehicles or other property by the traveller or a person under the traveller's supervision.

Tours, Safaris, Activities and Transfers

13.1Travellers must follow reasonable safety instructions issued by guides, drivers, rangers, park authorities and activity providers.

13.2Safari and adventure travel may involve uneven roads, remote locations, wildlife, insects, changing weather, limited medical facilities and other inherent risks. By booking, you acknowledge these ordinary risks. This does not excuse negligence or breach of a legal duty by Bella Safaris or a supplier.

13.3Pick-up times are estimates and may be affected by traffic, weather, road conditions, immigration, baggage delays and other operational factors. You must provide accurate arrival and contact details and promptly notify us of changes.

13.4If you fail to arrive at the agreed meeting point within the stated waiting time and cannot be contacted, the service may be treated as a no-show. Additional waiting or replacement-transfer charges may apply.

13.5Bella Safaris may remove a traveller from an activity or terminate services, without refund for unused services, where the traveller's conduct is unlawful, abusive, dangerous, discriminatory, seriously disruptive, or puts people, wildlife or property at risk. The traveller remains responsible for resulting costs and damage.

Passports, Visas, Health and Entry Requirements

14.1Each traveller is responsible for obtaining and carrying a valid passport, visa, permit, vaccination certificate, insurance document and any other required travel or entry document.

14.2Entry, health and visa requirements can change. Information provided by Bella Safaris is general assistance and should be verified with the relevant embassy, immigration authority, airline or qualified health professional before travel.

14.3Bella Safaris is not responsible where a traveller is denied boarding or entry because of missing, invalid or insufficient documents, except where directly caused by incorrect written information negligently provided by us.

14.4You must disclose, before booking, any mobility need, medical condition, allergy, pregnancy-related consideration or other circumstance that may materially affect participation or require special arrangements. We will handle health information confidentially and only share it where reasonably necessary to arrange the service.

Children and Minors

15.1A parent or legal guardian must make or authorise a booking for a traveller under 18 years and provide any required consent or travel documentation.

15.2Child ages and supplier policies vary. The child's correct age on each travel date must be provided at booking. Incorrect information may result in repricing, refusal of service or additional charges.

15.3A responsible adult must supervise minors unless a service expressly provides otherwise.

Travel Insurance

16.1We strongly recommend that every traveller obtains comprehensive travel insurance from the date of booking. Cover should include medical expenses, emergency evacuation and repatriation, cancellation, curtailment, missed departure, baggage, personal liability and Force Majeure-related risks where available.

16.2Travellers are responsible for understanding the policy terms, exclusions and claims procedure. Bella Safaris does not determine an insurer's claim decision unless we are the insurer.

17

Complaints and Assistance During Travel

17.1If a problem arises, you must promptly notify the relevant supplier and Bella Safaris and allow a reasonable opportunity to resolve it. Our emergency or after-hours contact details, where applicable, will be provided with the travel documents.

17.2If the problem is not resolved, submit a written complaint with supporting documents within 14 days after the service or trip ends, or as soon as reasonably practicable if circumstances prevent this. We will acknowledge and investigate the complaint and aim to provide a substantive response within a reasonable time.

17.3Failure to report a problem when it could reasonably have been corrected may affect the remedy available, but does not remove any non-excludable legal right.

18

Refunds

18.1Approved refunds will normally be made to the original payer using the original payment method, unless the payer and Bella Safaris agree otherwise or law requires a different method.

18.2Refund timing may depend on airlines, hotels, other suppliers, banks and card processors. We will process any amount held by us promptly and will keep you reasonably informed where a supplier refund is outstanding.

18.3Unless required by law, Bella Safaris is not obliged to advance a refund before receiving the corresponding funds from a supplier where we acted only as that supplier's agent.

18.4Bank, card, exchange-rate and transfer differences may affect the final amount received. We will not deduct undisclosed charges.

19

Liability

19.1Bella Safaris will perform its services with reasonable care and skill. We are responsible for loss that is a reasonably foreseeable result of our breach of contract, negligence or other legal duty, subject to these Terms and applicable law.

We are not liable for loss caused by:

  • the traveller's act, omission or failure to follow instructions;
  • an independent third party unconnected with the contracted services and whose conduct was not reasonably foreseeable or avoidable;
  • a Force Majeure Event; or
  • an inherent travel risk that remains despite reasonable care.

19.3To the fullest extent permitted by law, Bella Safaris' total liability arising from a booking will not exceed the total amount paid to Bella Safaris for the affected service, except where a different limit is required by applicable law or an applicable international convention.

19.4We are not liable for indirect or consequential loss, loss of profit or business loss where the booking was made for personal travel and the loss was not disclosed and accepted when the contract was formed.

19.5Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, breach of mandatory consumer rights, or any other liability that cannot lawfully be excluded or limited.

20

Personal Information and Privacy

20.1Bella Safaris processes personal data in accordance with the Constitution of Kenya, the Data Protection Act, 2019, applicable regulations and our Privacy Policy.

20.2We collect and use information reasonably necessary to provide quotations and bookings, process payments, meet legal duties, protect against fraud, communicate with travellers and improve our services.

20.3We may share necessary information with airlines, hotels, tour operators, guides, transport providers, insurers, payment processors, government or border authorities, technology providers and other parties involved in delivering or regulating the booking. Some recipients may be outside Kenya. Appropriate safeguards will be used where required.

20.4We do not sell personal data. Marketing communications will be sent only where legally permitted, and you may opt out at any time.

20.5Subject to applicable law, travellers may request access to, correction, restriction, objection, portability or erasure of their personal data. Requests should be sent to info@bellasafaris.com.

Our Privacy Policy explains the categories of data collected, lawful bases, purposes, recipients, international transfers, security, retention periods, data-subject rights, cookies and complaint process.

Payment Security and Fraud Prevention

21.1We may carry out reasonable identity and payment verification before confirming a booking.

Important: Do not send a full payment-card number, PIN, CVV/security code, online-banking password or an unredacted image of a payment card by email, WhatsApp or any unsecured channel. Bella Safaris will never request your PIN, password or CVV.

21.3Any requested document must be transmitted through an approved secure method and handled in accordance with our Privacy Policy and applicable data-protection law.

21.4If verification is not completed within a reasonable time, we may decline or cancel the booking and refund any funds we hold, less any properly disclosed and unavoidable supplier charge already incurred.

Website Use and Intellectual Property

22.1Website content is provided for general information and personal, non-commercial use. It does not constitute a confirmed offer unless expressly stated.

22.2Text, photographs, graphics, logos, itineraries and other content owned by or licensed to Bella Safaris are protected by applicable intellectual-property laws. They may not be copied, republished, distributed, modified or commercially used without prior written permission, except as permitted by law.

22.3You must not misuse the Website, introduce malicious code, attempt unauthorised access, scrape content in breach of law, impersonate another person or use the Website for fraudulent or unlawful activity.

22.4Links to third-party websites are provided for convenience. We do not control their content, security, availability or privacy practices.

22.5We use reasonable care to keep Website information accurate and available but do not guarantee uninterrupted access or that all content will always be current or error-free.

Changes to These Terms

23.1We may update these Terms from time to time by publishing the revised version and effective date on our Website.

23.2Changes will apply to Website use from the new effective date. A material change will not retrospectively alter a confirmed booking unless required by law or agreed with you in writing.

24

Governing Law and Dispute Resolution

24.1These Terms and every booking with Bella Safaris are governed by the laws of Kenya, unless mandatory law applicable to the traveller provides otherwise.

24.2The parties should first attempt to resolve a dispute in good faith through Bella Safaris' internal complaint process.

24.3If the dispute is not resolved within a reasonable time, the parties may agree to mediation in Kenya before commencing court proceedings. This clause does not prevent either party from seeking urgent relief or using any regulator, tribunal, consumer remedy or court available under applicable law.

24.4Subject to any mandatory jurisdiction, the courts of Kenya will have jurisdiction.

25

General Provisions

25.1If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

25.2A delay or failure to enforce a right is not a waiver of that right.

25.3You may not transfer a booking or your rights under it without our written consent and any required supplier approval. Bella Safaris may use suppliers and subcontractors to perform the services but remains responsible for its own contractual obligations.

25.4These Terms do not give enforcement rights to a person who is not a party to the booking, except a traveller included in the booking or where applicable law provides otherwise.

25.5Notices relating to a booking must be sent through the official contact details shown on the quotation, confirmation or Website. You must keep your contact information current and monitor messages during the booking and travel period.

Acceptance

By clicking acceptance, signing a quotation or booking form, instructing us to proceed, or making any payment toward a booking, you confirm that:

  • you are at least 18 years old and authorised to act for all travellers in the booking;
  • all information supplied is accurate and complete;
  • you have shared these Terms and all material booking conditions with the other travellers; and
  • you accept these Terms, the confirmed quotation or itinerary, and the applicable supplier conditions.
